Terms of Service

1. Agreement

These terms apply to your use of the SMEUp mobile app and related services, operated by SME Services Cloud. By using SMEUp you agree to them. If you do not agree, please do not use the app.

2. Your account

You are responsible for keeping your sign-in credentials secure and for activity that happens under your account. Tell us promptly at contact@smess.vn if you believe your account has been accessed without your permission. You must give accurate account information and keep it up to date.

3. Acceptable use

You agree not to:

• use SMEUp for anything unlawful
• attempt to gain unauthorised access to the service or to other users' data
• interfere with or disrupt the service or the infrastructure behind it
• reverse engineer or attempt to extract the source code of the app
• upload malicious code, or content you have no right to upload

4. Your content

The business data you put into SMEUp remains yours. You grant us only the permission we need to store and process it in order to provide the service to you. You are responsible for the content you upload, including having a lawful basis to hold any personal data about your own customers.

5. Our content

The app itself — its software, design, and branding — belongs to us and is protected by intellectual property law. These terms do not transfer any of those rights to you.

6. Service availability

We work to keep SMEUp available and reliable, but we do not guarantee uninterrupted service. We may change, suspend or discontinue features, and we may need to take the service down for maintenance.

7. Ending your use

You may stop using SMEUp and delete your account at any time — see Delete your account. We may suspend or terminate an account that breaches these terms or that is being used unlawfully.

8. Disclaimer

SMEUp is provided "as is". To the extent permitted by law, we do not give warranties of any kind about the service. SMEUp is a business management tool — it does not provide legal, tax or accounting advice, and you should not rely on it as such.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue or data, arising from your use of SMEUp.

10. Privacy

Our Privacy Policy explains how we handle your data and forms part of these terms.

11. Changes

We may update these terms. When we do we will revise the "Last updated" date above, and we will tell you about significant changes in the app or by email. Continuing to use SMEUp after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Vietnam, and the courts of that jurisdiction have exclusive jurisdiction over any dispute arising from them.
